05Requests and communication
By submitting a request through the form on the Site, you confirm the accuracy of the information provided and consent to the processing of personal data in accordance with the Privacy Policy.
We aim to respond to requests within one business day. This timeframe is indicative and does not constitute a contractual obligation.
Submitting a request and subsequent correspondence does not constitute a contract and creates no obligations for either party to provide or pay for services. Contractual relations arise upon signing a separate agreement or approving a proposal.
06How services are provided
Each project is documented in a separate agreement or proposal that sets out the scope of work, stages, timelines, cost and acceptance procedure. The terms of a specific agreement prevail over the general provisions of this section.
The general workflow:
- Briefing and estimation — clarifying the task, goals and constraints; preparing a proposal.
- Agreement — fixing the scope, cost and timelines in a contract.
- Delivery in stages — handing over interim results for review.
- Revisions — the number of revision rounds at each stage is defined by the contract.
- Acceptance — handover of final materials and source files.
The Client undertakes to provide the necessary materials, access and feedback in a timely manner. Delays on the Client’s side shift the delivery timelines accordingly.
07Payment and timelines
The cost of services is determined individually based on the project estimate. Prices on the Site or the budget ranges in the form are indicative and do not constitute a public offer.
- Work is generally performed on a prepayment basis or in stages according to a payment schedule.
- Payments are made off-site on the basis of issued invoices.
- Expansion of scope at the Client’s initiative is documented in an additional agreement and paid for separately.
- In the event of early termination, work actually performed is paid for.
08Rights to deliverables
Economic intellectual property rights to materials created under the project pass to the Client after full payment of the service cost, unless otherwise stated in the contract.
Until full payment is made, all deliverables remain the property of the Agency.
The Agency retains the right to use completed work in its own portfolio, presentations and marketing materials, unless the Client has objected in writing.
Licences for fonts, stock images, libraries and third-party services used in the project are purchased in the Client’s name and paid for by them separately, unless agreed otherwise.
09Confidentiality
The Agency undertakes not to disclose information received from the Client during cooperation and marked as confidential. At the Client’s request, a separate non-disclosure agreement (NDA) is signed before work begins.
10Limitation of liability
The Site’s materials are provided “as is”. We make an effort to keep information current and accurate, but we do not guarantee its completeness and are not liable for decisions made on its basis.
The Agency is not liable for:
- Temporary unavailability of the Site due to maintenance or provider outages.
- Indirect damages, lost profit or reputational harm caused by use of the Site.
- Consequences of the Client independently modifying delivered materials after acceptance.
- The operation of third-party services and integrations chosen by the Client.
The Agency’s aggregate liability for a specific project is limited to the amount actually paid by the Client for the relevant stage of work.
11Third-party links
The Site may contain links to external resources. We do not control their content and are not responsible for their operation, privacy policies or the accuracy of information posted there. You follow such links at your own risk.
12Dispute resolution
These Terms are governed by the laws of Ukraine. The parties will seek to resolve all disputes through negotiation.
If no agreement is reached, the dispute is referred to the competent court at the Agency’s location, unless another procedure is established by contract or by mandatory provisions of law.
13Changes to the Terms
The Agency may update these Terms. A new version takes effect from the moment it is published on this page; the date of the last update is shown at the top.
Continued use of the Site after changes means you accept the updated version. We recommend reviewing this page periodically.
